      See, I don't really know what .16 means in real life. Meaning, I've never been able to know what my BAC is and how I feel at the different levels. I know it's over the limit and all...I was always curious what my BAC is at different stages of drinking.

          probably was higher than that, they took his sample 2 1/2 hours after he got pulled over

            Walgreens sells BAC testers for about $50, they are next to the pregnancy tests. Not sure how accurate they are, I've had 2 of theirs. You can buy more expensive ones online.

              i think its also a combination of if you've eaten and also tired. Like I can drink beer and i wont start to feel it until like the 4th one (im a light weight) Liquor on the otherhand, that will hit me quick.

                  It does mean that instead of a class B misdemeanor as a first DWI, you're charged with a Class A misdemeanor for having a BAC greater than .15.

                            A good attorney can get him plead down to possibly Class B DUI due to the time delay. There's a specific calculation they use for blood-drawn BAC because of the differential. He wasn't a .16 at the time of the accident therefore he cannot be tried for Class A. His attorney will argue that 3ish hours increased his BAC .xxx amount and try for dismissal.
